Waiver and Release of Liability – Warrior’s Bridge Foundation (Doing Business as Chen’s Wing Chun Gung Fu)

IMPORTANT: THIS IS A LEGAL DOCUMENT. PLEASE READ CAREFULLY BEFORE SIGNING.

  

1.   Acknowledgment of Risk

I understand that participation in martial arts training, including but not limited to Wing Chun Kung Fu, involves physical contact and strenuous activity. These activities carry inherent risks of serious injury, illness, communicable disease exposure (including COVID-19), emotional distress, permanent disability, property damage, and death. I knowingly and voluntarily assume full responsibility for all such risks, whether caused by my own actions, the actions of others, the negligence of Eric Chen, Warrior’s Bridge Foundation (doing business as Chen’s Wing Chun Gung Fu), the landlord or property owner of the premises, or otherwise.

 

2.   Release of Liability

In consideration for being permitted to participate, I hereby release, waive, and discharge Eric Chen, Warrior’s Bridge Foundation, its instructors, staff, volunteers, affiliates, successors, assigns, and the landlord or property owner of the premises, from any and all liability, claims, demands, actions, or causes of action arising out of my participation, including but not limited to negligence.

This release extends to any claims for physical or psychological injury, illness, economic loss, emotional harm, death, or property damage incurred during or arising out of my participation, including travel to or from training or events.

 

3.   Indemnification

I agree to indemnify and hold harmless Eric Chen, Warrior’s Bridge Foundation, and the landlord or property owner of the premises from any claims, lawsuits, or actions brought by me, my family, my heirs, or third parties on my behalf. This includes responsibility for all legal costs, attorney’s fees, and related expenses incurred in defending such claims.

 

4.   Medical Responsibility

I understand and agree:

• I am solely responsible for my own medical expenses.

• I am encouraged to maintain my own health and accident insurance.

• In the event of injury, I authorize Warrior’s Bridge Foundation to secure emergency medical care at my expense.

 

5.   Property Damage

I agree to be financially responsible for any damage to facilities, training equipment, or property caused by my willful misconduct, recklessness, or negligence.

 

6.   Rules and Conduct

I agree to follow all safety rules, guidelines, and instructions given by instructors. I understand that failure to comply may increase my risk of injury and may result in removal from class without refund.

 

7.   Photo and Video Release (Optional)

I grant Warrior’s Bridge Foundation the right to photograph, film, or otherwise record my participation in activities and to use such images for promotional, educational, or commercial purposes without compensation. (If you do not consent, please strike through this clause before signing.)

 

8.   Dispute Resolution

Any dispute arising out of this agreement shall be resolved by binding arbitration under the rules of the American Arbitration Association. Venue shall be exclusively in Ventura County, California, and governed by California law.

 

 9.  Class Action Waiver

I agree that any dispute resolution shall be conducted solely on an individual basis. I waive the right to participate in any class, consolidated, or representative action against Warrior’s Bridge Foundation or the landlord/property owner of the premises.

10.  Severability

If any provision of this agreement is found unenforceable, the remaining provisions shall remain in effect.

 

11.  Age Certification

I affirm that I am at least 18 years old and legally competent to sign this document.

Parental Consent and Release for Minors (Under 18)

I, the undersigned parent or legal guardian of the minor participant named below, hereby consent to their participation in martial arts training at Warrior’s Bridge Foundation. I acknowledge that I have read this waiver, understand its terms, and agree on behalf of myself and the minor. I further agree to indemnify and hold harmless Eric Chen, Warrior’s Bridge Foundation, and the landlord or property owner of the premises from any claims arising out of the minor’s participation.
